Direito à Privacidade
Right of Privacy
· Judge Cooley (1880): “the right to be let alone”
· Samuel D. Warren and Louis Brandeis (1890): (a) the intrusion upon the persons’ seclusion or solitude, or into his or her private affairs(b) the publicity which places the person in a false light before the public eyes(c) the public disclosure of embarrassing private facts about the person
(d) the appropriation of a person name or likeness aiming an advantage
· Evolução do conceito com diferentes definições ao longo do Século XX: a right to control the information about ourselves; be able to communicate the information; or to keep it for ourselves
Right of Privacy – EUA · Fourth Amendment - “Penumbra Right”
"the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.”
· A Suprema Corte Americana entende estar implícito o Direito à Privacidade nesta emenda
United States 389 U.S. 347 (1967)]:
“[F]irst that a person have exhibited an actual (subjective) expectation of privacy and, second, that the expectation to be one that society is prepared to recognise as ‘reasonable’"
Right of Privacy - UK
· Tentativas de definição do direito: - Calcutt Committee (Report of the Committee on Privacy and Related Matters) (1990): "The right of the individual to be protected against intrusion into his personal life or affairs, or those of his family, by direct physical means or by publication of information.”
- Government Response to the National Heritage Select Committee, Privacy and Media Intrusion (1995): "Every individual has a right to privacy comprising: (a) a right to be free from harassment and molestation; and (b) a right to privacy of personal information, communications, and documents.“
Right of Privacy - UK
· Proteções específicas relacionadas a privacidade:
- Consumer Credit Act 1974
- Rehabilitation of Offeders Act 1974
- Interception of Communications Act 1985 and Police Act 1997
- Broadcasting Act 1996
- Protection from Harassment Act 1997
· Tablóides
Right of Privacy - UK· Human Rights Act 1998 - incorporou o European Convention on Human
Rights (ECHR)ARTICLE 8
Right to respect for private and family life1 Everyone has the right to respect for his private and family life, his
home and his correspondence.2 There shall be no interference by a public authority with the exercise of
this right except such as is in accordance with the law and is necessary in a democratic society in the interests of national security, public safety or the economic well-being of the country, for the prevention of disorder or crime, for the protection of health or morals, or for the protection of the rights and freedoms of others.

Image Rights na Inglaterra
· RIHANNA VS. TOPSHOP
“It is important to state at the outset that this case is not concerned with so called "image rights". Whatever may be the position elsewhere in the world, and how ever much various celebrities may wish there were, there is today in England no such thing as a free standing general right by a famous person (or anyone else) to control the reproduction of their image. There is a developing law of privacy but no question of that arises in this case. The taking of the photograph is not suggested to have breached Rihanna's privacy. A celebrity may control the distribution of particular images in which they own the copyright but that right is specific to the particular photographs in question. Whether an image right can or should be developed is not what this case is concerned with.”
· Passing Off: Goodwill, Misrepresentation e Damage
· Decisão do caso Rihanna x TOPSHOP
“The mere sale by a trader of a t-shirt bearing an image of a famous person is not, without more, an act of passing off. However the sale of this image of this person on this garment by this shop in these circumstances is a different matter. I find that Topshop's sale of this Rihanna t-shirt without her approval was an act of passing off. I find for the claimants.”
Image Rights nos EUA· CELEBRITIES RIGHTS ACT (California 1985) - Assegura direitos após a morte de
celebridades para seus herdeiros:- that personality had been "any natural person whose name, voice, signature, photograph, or likeness has commercial value at the time of his or her death",- any person using such personality's "name, voice, signature, photograph or likeness on or in products, merchandise or goods" without prior consent was liable to be sued for damages and profits arising from the unauthorized use, and- such prior consent may only be given by persons to whom the personality had transferred such power by contract or trust prior to his death, or by trust or will after his death, or, where no such latter provision was made, his spouse, children, and/or grandchildren, but
- "a play, book, magazine, newspaper, musical composition, audiovisual work, radio or television program, single and original work of art, work of political or newsworthy value, or an advertisement or commercial announcement for any of these works, shall not be considered a product, article of merchandise, good, or service if it is fictional or nonfictional entertainment, or a dramatic, literary, or musical work.“
Shaw Family Archives Ltd. v. CMG Worldwide, Inc., 486 F.Supp.2d 309 (S.D.N.Y., 2007)
