In March 2019, the Indiana Supreme Court published an opinion, State v. Bobadilla 117 N.E.3d 1272 (2019) that addressed a criminal defense attorney’s ethical obligations to advise noncitizen clients of direct immigration consequences of a criminal conviction. Bobadilla is a continuation of what The United State Supreme Court in Padilla v. Kentucky, 559 U.S. 356 (2010) already mandated as effective assistance of counsel under the 6th Amendment. Come and learn the tools to advise your noncitizen client and learn the history of how this team of attorneys litigated this favorable ruling for our noncitizen Hoosiers. You will learn basic immigration vocabulary and key questions to ask your noncitizen clients before advising them. This is an essential CLE for all criminal defense practitioners.

Hawkins will describe the procedural evolution of creditors’ claims against decedents’ assets over the past decade, culminating in the enactment of 2018 Senate Enrolled Act No. 247 and 2019 Senate Enrolled Act No. 518. Phillipp and Hawkins will explain the impact of 2019 SEA 518 on creditor’s rights to recover against real property in decedents’ probate estates and against decedents’ non-probate assets. In June, the U.S. Supreme Court overruled its roundly criticized Williamson County precedent, which for more than 30 years had required that property owners first seek just compensation under state law in state court before bringing a federal takings claim under 42 U.S.C. §1983. In his opinion for the Court, Chief Justice Roberts wrote, “Williamson County was not just wrong. Its reasoning was exceptionally ill founded and conflicted with much of our takings jurisprudence.” In her dissent, Justice Kagan stated that the majority’s decision “transgresses all usual principles of stare decisis”, and that its consequence “is to channel a mass of quintessentially local cases involving complex state-law issues into federal courts.” Our panel will discuss whether the Knick decision means that appeals from Indiana plan commission and zoning board rulings will now be more likely to be filed in federal rather than state trial courts.

HOT TOPICS Cannabis Conundrum: The Ethics of Advising Cannabis Entrepreneurs (1 hr. CLE/Ethics)Presented by the Legal Ethics CommitteeLori Jean, Krieg DeVault LLP

The confluence and inconsistency of federal and state law regarding the legality of cannabis presents a problem for lawyers as they advise their clients in the cultivation, processing, sale and use of marijuana, industrial hemp and their derivative products, like CBD. Lawyers are sworn to uphold the law and are guided by Indiana Rules of Professional Conduct. Specifically, Rule 1.2(d) states that a lawyer “shall not counsel a client to engage, or assist a client, in conduct that the lawyer knows is criminal or fraudulent” thus raising this question of ethics: to what extent can lawyers advise cannabis entrepreneurs without running afoul of ethics rules? This session will: (1) address the current state of the law regarding marijuana and industrial hemp, including CBD; (2) examine the various approaches taken under state ethics rules, including that of Indiana; and (3) discuss additional factors to consider for counsel who chooses to advise a cannabis business.
