O código de conduta ética da Universidade do Minho (UMinho), doravante também designada por Universidade, estabelece uma afirmação de valores e um conjunto de normas que orientam a missão da Instituição nas suas atividades de ensino e aprendizagem, de formação, de investigação científica e de interação com a sociedade, alicerçando-se nos princípios éticos de equidade e justiça, do respeito pela dignidade da pessoa humana e da responsabilidade pessoal e profissional, em obediência à lei geral e aos estatutos da Universidade e demais regulamentos e legislação aplicável.

A comunidade académica não pode deixar de estar envolvida com um compromisso ético, assumindo-o na sua agenda, individualmente e como corpo, para o discutir, densificar e desenvolver, com a riqueza que advém da diversidade saudável, no caminho do progresso do papel do sistema de ensino superior e no respeito pela autonomia da Universidade. Este caminho tem de se fazer caminhando e um dos passos fundamentais é dado com a assunção clara e inequívoca daquele compromisso ético.

The Code of Ethical Conduct of the University of Minho (UMinho), henceforth also referred to as University or Institution, establishes a set of values and norms that guide the mission of the Institution in its activities of teaching, learning, training, research and interaction with society, based on the ethical principles of equity and justice, respect for the dignity of the human person as well as personal and professional responsibility, thus observing general law, the University statutes, and further applicable regulations and legislation.

The academic community, both as individuals and collectively, is engaged with an ethical commitment, which must be discussed, enhanced and developed with the richness that comes from healthy diversity, establishing a path towards the progress of the role assigned to the higher education system and towards respect for the autonomy of the University. This path is made of small steps and one of the main steps is the clear and unambiguous affirmation of that ethical commitment.

Thus, the purpose of this code is to provide the academic community with ethical guidelines compatible with the promotion of professionalism


O objetivo deste código é, assim, o de apetrechar a comunidade académica com uma linha de orientação ética compatível com a promoção do profissionalismo e da excelência na sua ação, em conformidade com os princípios orientadores legais e estatutários do respeito pela dignidade humana, da igualdade e da justiça, da participação democrática livre e do pluralismo de opiniões e orientações.

O código enquadra as atividades prosseguidas na Universidade, conforme explicitadas nos seus estatutos, e diz respeito a toda a comunidade académica constituída pelo pessoal docente, pessoal investigador, pessoal não docente e não investigador, e pelos estudantes dos 1º, 2º e 3º ciclos de estudos conducentes aos graus de, respetivamente, licenciado, mestre e doutor, bem como pelos estudantes de outros cursos ou ações de formação levadas a cabo na Instituição ou em colaboração com esta.

O presente documento, elaborado pela Comissão de Ética da Universidade do Minho (CEUM), está organizado em quatro Capítulos. O primeiro diz respeito à conduta ética institucional, no âmbito de toda a comunidade académica. Nos outros três

The code refers to all activities undertaken at the University, as indicated in its statutes, and concerns the entire academic community, which is composed of teaching staff, research staff, non-academic staff and the students in the 1st, 2nd and 3rd study cycles leading to the degrees of bachelor, master or doctor, respectively, as well as the students of other programmes or training courses conducted at the Institution or in collaboration with it.

The present document, drafted by the University of Minho Ethics Committee (CEUM), is divided into four chapters. The first chapter concerns the institutional ethical conduct and applies to the entire academic community. The remaining three chapters deal with the pedagogical and research dimensions. Chapter II is devoted to academic conduct; Chapter III refers to general conduct in research activities; and Chapter IV regards conduct in research with human beings or animals, specifically.

Valores e princípios éticos institucionais

A ética constitui um pilar vital da qualidade do ensino e da investigação da Universidade, legitimando a sua autonomia e envolvendo um firme compromisso perante os cidadãos e a sociedade.

Assim, a Universidade promove os valores da transparência e da integridade académica em todas as suas atividades e adota uma conduta assente nos princípios éticos da justiça e equidade, do respeito pela dignidade da pessoa humana e da responsabilidade profissional e social, que se concretiza por normas, deveres e atitudes, de que se salientam os seguintes:1. O respeito pela igualdade de oportunidades

de toda a comunidade académica, não só ao nível do acesso e desempenho dos estudantes, bem como no da progressão das carreiras profissionais dos docentes, investigadores, trabalhadores não docentes e não investigadores, sem qualquer tipo de discriminação, de dependência ou subordinação;

Thus, the University promotes the values of academic integrity and transparency in all of its activities and adopts a conduct grounded upon the ethical principles of justice and equity, respect for the dignity of the human person as well as social and professional responsibility, which is accomplished through norms, duties and attitudes, with a particular emphasis on:1. 8. O reconhecimento de que todos os membros da comunidade académica têm direito a ser assistidos de forma pronta e profissional, em casos de acidente ou doença súbita ligados ao exercício das suas funções.

Obrigações gerais da comunidade académica

Constituem deveres gerais de todos os membros da comunidade académica, para além do respeito pela lei geral, pelas pessoas e pelos regulamentos aplicáveis às atividades prosseguidas pela Universidade, designadamente, os seguintes:1. Promover o interesse público no exercício das

suas atividades;2. Respeitar e tratar com urbanidade e correção

não prestar falsas informações e não cometer falsificações;

5. Não praticar atos de violência, qualquer que ela seja;

6. Não consumir substâncias ilícitas ou que possam afetar o correto desempenho de funções;

7. Cumprir zelosamente as normas de higiene e segurança previstas;

8. Preservar o estado das instalações, equipamentos e ambiente natural dos espaços da Universidade;

The general duties of all the members of the academic community, in addition to respect for the general law, people and regulations applicable to the activities conducted by the University, are as follows:1. of the academic community;3. To not make slanderous accusations, to not

provide false information and to not engage in forgery;

4. To respect the property of all the members of the community and that of the University;

5. To not engage in acts of violence, whatever they may be;

6. To not use illicit substances or any substances liable to affect the proper performance of duties;

7. To fulfil thoroughly the norms of safety and hygiene;

8. To preserve the conditions of the facilities, equipment and natural environment of University spaces;

São obrigações específicas dos docentes, dos investigadores e dos trabalhadores não docentes e não investigadores, designadamente, as que a seguir se referem:1. Atuarem com uma postura profissional pautada

pelos valores da honestidade, pela competência e disponibilidade;

2. Serem assíduos e pontuais no exercício das suas funções, bem como na participação em reuniões obrigatórias;

3. Agirem perante todos os membros da comunidade académica com responsabilidade, isenção, imparcialidade e transparência;

4. Guardarem sigilo profissional sobre todos os factos e elementos de que tenham conhecimento, quando tal seja exigido.

Specific obligations of teaching staff, research staff and non-academic staff

Specific obligations of teachers, researchers, non-teaching staff and non-research staff are the following:1. To adopt a professional posture guided by the

values of honesty, competence and availability;2. To be diligent and punctual in the performance

of duties as well as in the participation in mandatory meetings;

3. To act before all the members of the academic community with responsibility, exemption, impartiality and transparency;

4. To maintain professional secrecy about all the facts and elements of which they might be aware when such is demanded;


Atividades de interação com a sociedade

Pela relevância que adquiriu publicamente, perante a sociedade, a nível regional, nacional e internacional, como centro de criação, divulgação e transferência de conhecimento e como referência ética, cultural e humanista, a Universidade tem promovido um relacionamento muito especial com a comunidade exterior, designadamente:1. Ao nível da promoção e divulgação da ciência, da

cultura, da educação e dos valores de cidadania;2. Através de uma cooperação interinstitucional

no plano pedagógico, científico e tecnológico, traduzida em ações de formação, seminários, conferências, congressos e outras iniciativas;

3. Mediante programas de transferência de tecnologia e inovação, de execução de projetos de investigação e desenvolvimento tecnológico, bem como ao nível do empreendedorismo em atividades de criação de consórcios, institutos e outras instituições de interface universidade-empresa.Na vertente da interação com a comunidade

and research for which they are responsible at the University.


Consequências em casos de conduta imprópria dos docentes, investigadores e trabalhadores não docentes e não investigadores

Nos termos da lei geral e do artigo 9.º dos seus estatutos, a Universidade possui autonomia disciplinar pertencendo ao reitor o poder disciplinar, assessorado por um conselho disciplinar.

No caso dos docentes, investigadores e trabalhadores não docentes e não investigadores, o exercício do poder disciplinar rege-se pelo estatuto disciplinar dos trabalhadores que exercem funções públicas (Lei n.º 58/2008, de 9 de setembro) e demais legislação aplicável.

Consequences in case of misconduct by teaching staff, research staff and non-academic staff

Under the terms of general law and article 9 of its statutes, the University enjoys disciplinary autonomy, and the Rector holds disciplinary power, assisted by a disciplinary council.

In the case of teachers, researchers and non-academic staff, the exercise of disciplinary power is governed by the disciplinary statutes of employees performing public functions (Law 58/2008 of 9 September) and further applicable legislation.

Em consonância com os estatutos da Universidade e tendo presentes os princípios éticos institucionais, a ação dos estudantes, enquanto membros nucleares da comunidade académica, deve pautar-se por valores e princípios éticos fundamentais para o sucesso do seu desempenho educativo e para a formação de cidadãos livres, responsáveis e competentes.

As normas de conduta ética académica aplicam-se a todos os estudantes da UMinho, independentemente das qualificações a obter nas múltiplas atividades aí prosseguidas, em especial às de ensino e aprendizagem, de formação e investigação, designadamente no âmbito dos ciclos de estudos conferentes dos graus de licenciado, mestre e doutor, bem como noutras ações de formação pós-graduada ou formação contínua, levadas a cabo pela Universidade ou em colaboração com esta.

As normas de conduta aqui tratadas são alicerçadas num conjunto coerente de direitos e de obrigações de todos os estudantes, dando uma atenção específica e fundamental ao cumprimento honesto e responsável dos instrumentos e procedimentos usados na avaliação de conhecimentos, podendo assumir-se como

In compliance with the statutes of the University and bearing in mind the institutional ethical principles, all actions of students as core members of the academic community must be shaped by ethical principles and values that are crucial to the success of their educational performance and to the upbringing of free, responsible and competent citizens.

The norms of academic ethical conduct apply to each and every student of UMinho, regardless of the qualifications to be obtained in the various activities therein conducted, especially those of teaching, learning, training and research, and in particular within the scope of study cycles leading to bachelor, master and doctor degrees, as well as other graduate or continuous training courses carried out by the University or in collaboration with it.

The norms of conduct herein mentioned are based on a coherent range of rights and obligations of all the students, placing specific emphasis on the honest and responsible fulfilment of the procedures used in the assessment of knowledge. They can further be regarded as a chart of ethical conduct — or academic code of honour —, capable of strengthening habits, values and attitudes of moral and professional character.

Direitos dos estudantes

A missão educacional da Universidade implica que os estudantes inscritos em qualquer ciclo de estudos ou atividade reconhecida pela Instituição devem auferir de um ambiente de trabalho profissional e académico adequado e baseado no respeito e na confiança mútua entre os colegas e docentes. Devem pois beneficiar de um tratamento assente nos princípios de equidade, justiça e igualdade de oportunidades, designadamente:1. Usufruir de um ensino de qualidade que tenha

por base a formação humana ao mais alto nível nas suas dimensões ética, cultural, social, científica, artística, técnica e profissional;

2. Ter acesso atempado a todas as informações relevantes para o sucesso do seu desempenho, designadamente da parte dos diretores de curso, bem como dos Serviços Académicos, Serviços de Ação Social e outros órgãos e serviços relevantes;

3. Ser informados sobre os planos de estudo, objetivos e programas das unidades curriculares que vão frequentar;

4. Ver assegurado o direito de participação em órgãos da Universidade, através dos seus representantes eleitos ou nomeados;

Student rights

The educational mission of the University implies that students enrolled in any study cycle or activity acknowledged by the Institution must benefit from a professional and academic work environment based on respect and mutual trust between fellow students and the teachers. Students must therefore receive a treatment based on the principles of equity, justice and equality of opportunities, namely:1. To receive quality teaching based on high-level

human development in its ethical, cultural, social, scientific, artistic, technical and professional dimensions;

2. To have timely access to all the relevant information for the success of their performance, namely on the part of degree programme directors as well as the Academic Services, Social Services and other relevant bodies and services;

3. To be informed of all the study plans, objectives and syllabuses of the course units they will attend;

4. To enjoy the right to participate in University bodies through their elected or appointed representatives;


5. Ser informados pelos docentes responsáveis da formação, sobre as metodologias, instrumentos, critérios e prazos de avaliação adotados, nos termos do regulamento académico;

6. Ser informados sobre o regime de faltas e sobre os elementos que podem utilizar nas provas de avaliação de cada unidade curricular;

7. Ver avaliado o seu desempenho em termos objetivos, justos e transparentes;

8. Ter a garantia, da parte dos seus docentes e/ou orientadores científicos, da disponibilidade para discutir dúvidas ou assuntos relacionados com o seu trabalho académico de graduação ou de pós-graduação;

9. Poder aceder, nos termos regulamentares, a todos os serviços de apoio e aos meios disponíveis — bibliográficos, informáticos, laboratoriais ou outros — necessários ao desenvolvimento dos respetivos projetos de ensino;

10. Ser tratados com respeito e correção e sem qualquer forma de discriminação por todos os membros da comunidade académica;

11. Ter a garantia da confidencialidade de elementos e informações do foro pessoal ou familiar;

5. To be informed, by the teachers responsible for training, about the methodologies, tools, assessment deadlines and criteria adopted under the terms of the academic regulations;

6. To be informed about the system regarding absence and all items they are allowed to use for the exams of each course unit;

7. To have their performance assessed based on fair and transparent objectives;

8. To have the guarantee of availability from their teachers and/or scientific supervisors to discuss doubts or matters related to their academic work at undergraduate or graduate level;

9. To be able to access, in accordance to the regulations, all support services and the means available — bibliographic, computer, laboratory or others — necessary for the development of the respective teaching projects;

10. To be treated with respect and civility and without any kind of discrimination by all members of the academic community;

11. To have a guarantee of confidentiality of elements and information on private matters;

Deveres dos estudantes

Privilegiando a Universidade a formação humana ao mais alto nível e uma postura ética irrepreensível em todas as suas atividades, espera-se de toda a comunidade dos estudantes o respeito pela honestidade intelectual, assente nos mais elevados padrões de integridade e de responsabilidade.

Para além das obrigações gerais enquanto membros da comunidade académica, tratadas no Capítulo I, e das que são impostas pela lei geral aplicável, pelos estatutos da Universidade e demais regulamentos pertinentes, constituem deveres gerais dos estudantes:1. Ser assíduos, pontuais e disciplinados nas aulas

ou noutras sessões de trabalho constantes do plano de estudos;

2. Respeitar e tratar com correção e lealdade os docentes, investigadores, trabalhadores não docentes e não investigadores, colegas e demais membros da comunidade académica;

3. Acatar as normas de funcionamento e de segurança da Instituição, com respeito pela propriedade dos bens de todos os membros da comunidade académica e da Universidade;

4. Preservar as instalações, equipamentos e demais espaços de ensino, de investigação, sociais ou de lazer da Instituição;

In addition to the general obligations as members of the academic community, referred to in Chapter I, and those imposed by the applicable general law, by the University statutes and further relevant regulations, the general duties of students are as follows:1. Acts of dishonesty, incompatible with the academic integrity, are those in violation of the students’ general duties, and in particular those that benefit students under assessment with results obtained through fraudulent actions that violate procedures adopted for knowledge assessment processes, as well as actions concerning plagiarism, as indicated below.

Breach of procedures that protect the integrity of the knowledge assessment process

Among the breach of procedures that protect the integrity of the knowledge assessment process, those of particular note are:1. The use of cheat sheets, notes, texts or other

unauthorised items during the exams;2. The act of copying the work of someone else,

or part of it, or allow someone to copy one’s work or part of it during an exam;

3. Obtaining the help of someone else, on or off the premises where the exam is taking place, contrary to the rules established for the assessment method;


4. Signing someone else’s name on, inter alia, tests, exams or assignments subject to assessment;

5. Unjustified possession, prior to the exam, of forms, question sheets or other elements of the same exam;

6. The use of unauthorised technological means capable of facilitating access to information relevant for the exams or other assessment tests to one’s own advantage or to the advantage of others.

PlagiarismThe practice of plagiarism is regarded as any

situation where one uses ideas, claims, data, images or illustrations from other author(s) without the explicit acknowledgment of the same author(s).

Below can be found a non-exhaustive list of all the situations considered plagiarism of a literary, artistic or scientific work in the form of a report, article, essay, thesis or dissertation in paper or digital format, in part or in full:

Consequências em situações de conduta imprópria

Sem prejuízo de não se limitarem as violações ou infrações aos casos explicitados, fica ainda a advertência de que, em geral, qualquer ato desonesto e fraudulento que seja praticado para benefício direto ou indireto do infrator ou infratores, deverá ser considerado violação da integridade académica e sujeito a procedimentos sancionatórios.

As sanções disciplinares por atos de conduta académica ilícita, bem como a definição e regulamentação dos procedimentos a adotar, serão tratados em conformidade com a lei geral, com o regulamento disciplinar do estudante e demais regulamentos pertinentes.

Consequences in case of misconduct

Without prejudice to not restricting the violations or offences against the abovementioned cases, the warning remains that, in general, any dishonest and fraudulent act practiced for the direct or indirect benefit of the offender(s) should be considered as a violation of academic integrity and subject to sanctioning procedures.

The disciplinary sanctions for acts of illicit academic conduct, as well as the definition and regulation of the procedures to adopt shall be handled in compliance with general law, the student’s disciplinary regulations and further relevant regulation.

O código aplica-se a todas as pessoas envolvidas em atividades de investigação científica na Universidade ou em colaboração com esta, nomeadamente ao pessoal docente e investigador, aos investigadores não docentes e aos estudantes e bolseiros de investigação.

O código pretende sublinhar os princípios de boas práticas no campo da investigação científica, bem como alertar para casos tipificados de conduta imprópria que urge prevenir e erradicar.

Como princípios fundamentais deve entender-se que a ética na investigação científica implica sempre o respeito pela dignidade da pessoa humana, pelo progresso e valorização do conhecimento, pela qualidade e originalidade da investigação, pela verdade científica e pela liberdade de investigação.

The code applies to all the people involved in activities of research at the University or in collaboration with it, namely to the teaching and research staff, to non-academic staff as well as students and research grant holders.

The code aims to highlight the principles of best practices in the field of research, and to draw attention to typified cases of misconduct, which must be prevented and abolished.

As a fundamental principle, it should be understood that ethics in research always implies the respect for the dignity of the human person, for the progress and valorisation of knowledge, for the quality and originality of research, for the scientific truth and freedom of research.

All those engaged in research have special responsibilities to society, the University, funding entities and the research team involved.

The values of intellectual honesty, authenticity, objectivity, respect for intellectual property, methodological and experimental rigour, unbiased analysis of data, as well as the non-violation of the rights and dignity of human or animal subjects are all crucial to preserve the credibility and quality of research.

The most experienced researchers have a key role not only in the scientific supervision and guidance of their younger counterparts but also in the creation and maintenance of an ambience exuding integrity, rigour and critical thinking.

It should also be noted, however, that all researchers regardless of their experience or qualifications are required to maintain high standards of integrity compatible with a conduct that abides by the following principles and attitudes: 1. To ensure an ethical basis for all activities

of research;


2. To ensure that all research is conducted in compliance with the safety norms and protocols for people and goods;

3. To manage with transparency, justice and thrift the financial means delivered by the funding entities in order to ensure the success of the project within the target date;

4. To properly supervise the work developed by the students attending study cycles leading to the master’s and doctor’s degrees, as well as post-doctoral grant holders and other researchers;

5. To keep appropriate records that allow for the verification of the research results;

6. To ensure confidentiality in order to protect intellectual property, whenever such is applicable;

7. To ensure that the referencing of the sources used in the production of scientific work is rigorous and comprehensive;

8. To safeguard respect for copyright, making adequate mention of the sources used in the work;

Cases of misconduct

Situations that violate the integrity of the researcher and are therefore liable to penalties are typified non-exhaustively below:1. The practice of plagiarism; 2. The appropriation of someone else’s intellectual

creations, protected by the rules of intellectual property, without legal consent;

Como princípios gerais, a investigação com seres humanos ou animais deve ser realizada em coerência com o Código de Conduta Ética na Investigação Científica, constante do Capítulo III.

Do mesmo modo, a investigação tem de ser cientificamente justificada, cumprir critérios de qualidade científica e ser realizada em conformidade com as pertinentes obrigações e normas profissionais sob a supervisão de investigador(es) e/ou clínico(s) devidamente qualificado(s).

Importa ainda sublinhar que a informação necessária para a avaliação ética do projeto de investigação deve ser facultada por escrito ao(s) órgão(s) de ética competente(s), conforme estabelecido pela legislação aplicável ou órgão competente. Para o efeito, a Comissão de Ética da Universidade do Minho, através da Subcomissão de Ética para as Ciências da Vida e da Saúde, editará um guia indicativo dos procedimentos e do conjunto de documentos a apresentar à CEUM.

As a general rule, research with human beings or animals should be performed in compliance with the Ethical Conduct in Research included in chapter III.

Similarly, research must be scientifically justified, meet the necessary criteria of scientific quality and be conducted in compliance with the relevant obligations and professional norms under the supervision of duly qualified researchers and/or medical practitioners.

It should further be noted that the necessary information for the ethical assessment of a research project must be provided in writing to the competent ethical body(ies) as stipulated by the applicable legislation or competent body. For that purpose, the University of Minho Ethics Committee, through the Subcommittee of Ethics for the Life and Health Sciences, shall release a guide with the procedures and all the documents to submit to the University of Minho Ethics Committee.

3. A investigação não deve envolver riscos e encargos desproporcionais aos potenciais benefícios e deverá prevenir ou minimizar situações de desconforto e de sofrimento físico e psicológico dos sujeitos sob investigação;

Deve ser mantida a confidencialidade dos dados pessoais obtidos na investigação e não os reter para além do tempo necessário, em conformidade com o parecer do(s) órgão(s) de ética competente(s) e/ou leis e diretivas adequadas, ao fim do qual devem ser destruídos. Qualquer informação de caráter pessoal recolhida no decurso da investigação deve ser considerada confidencial e tratada de acordo

8. If the research results in relevant information for the present or future health or quality of life of the participants, that information should be conveyed to them at a health care or counselling facility;

9. A guarantee of insurance should be provided against the risk of accidents, physical or psychological damage that the human subjects may experience as a result of the research conducted.


Situações de conduta imprópria em investigação com seres humanos

No caso da investigação em humanos, quando for detetada uma inconformidade, esta deve ser avaliada e devem ser tomadas ações apropriadas para prevenir a sua ocorrência, a fim de assegurar que os participantes na investigação estejam protegidos. As inconformidades contínuas ou graves devem ser relatadas às autoridades reguladoras nacionais, ou autoridades competentes equivalentes, tal como definido na Diretiva 2001/20/EC, de 4 de abril, relativa à implementação de boas práticas clínicas em estudos clínicos pelos estados membros.

A suspensão de um estudo clínico pode ocorrer, designadamente, nas seguintes circunstâncias: (i) morte de um participante, (ii) alteração não aceitável na duração, (iii) gravidade ou frequência de eventos adversos, nomeadamente se os resultados do estudo levarem a comissão de ética (ou autoridade competente) a questionar e reavaliar a relação risco-benefício, ou a não conformidade do investigador16. Tais suspensões devem considerar uma revisão de todas as informações científicas, bem como a segurança e bem-estar dos participantes incluídos no estudo.

Cases of misconduct in research with human beings

In case of research on humans, whenever an anomaly is detected it should be assessed so that precautions may be taken to prevent its occurrence, thus ensuring the protection of the research participants. Continuous or serious anomalies should be reported to the national regulatory authorities or equivalent competent authorities, as defined in Directive 2001/20/EC, of 4 April concerning the implementation of good clinical practices in clinical trials by the member states.

The suspension of a clinical trial may occur, inter alia, under the following circumstances: (i) death of a participant; (ii) unacceptable change in the trial period; (iii) serious or frequent adverse events, particularly if the results of the study cause the ethics committee (or competent authority) to question and reassess the risk-benefit balance or the nonconformity of the researcher16. Such suspensions presuppose a revision of all the scientific information, as well as the safety and well-being of all the participants involved in the study.

Investigação com animais

Regras de conduta ética e de boas práticas na investigação com animais

Nos casos em que na investigação se utilizem animais para fins experimentais e outros fins científicos, será cumprida a legislação nacional em vigor: Decreto-Lei n.º 129/92, de 6 de julho17; Portaria n.º 1005/92, de 23 de outubro18; Portaria n.º 466/95, de 17 de maio19; Decreto-Lei n.º 197/96, de 16 de outubro20; e Portaria n.º 1131/97, de 7 de novembro21. Deverá ainda ter-se em conta a nova Diretiva Europeia 2010/63/EU, de 22 de setembro de 201022, relativa à proteção dos animais utilizados para fins científicos, que se prevê vir a estar transposta para a legislação nacional em 2013. Ao aplicar-se o disposto no anexo I da Portaria n.º 1005/92, de 23 de outubro, serão aplicadas as boas práticas referidas na Recomendação da Comissão Europeia n.º 2007/526/CE, de 18 de julho23, que contém diretrizes resultantes da última revisão do apêndice A da Convenção Europeia sobre a Proteção dos Animais Vertebrados utilizados para fins experimentais e/ou outros fins científicos (Convenção ETS 12324). A utilização de animais para fins científicos é ainda regida por regulamentos internos das unidades de investigação da UMinho,

Rules of ethical conduct and best practices in research with animals

Whenever animals are used in research for experimental and other scientific purposes, the national legislation in force shall be observed: Decree-law 129/92 of 6 July17, Ordinance 1005/92 of 23 October18; Ordinance 466/95 of 17 May19; Decree-law 197/96 of 16 October20 and Ordinance 1131/97 of 7 November21. One should further observe the new European Directive 2010/63/EU of 22 September 201022 concerning the protection of animals used for scientific purposes, which is expected to be transposed to national legislation in 2013. The enforcement of the provisions laid down in Annex I of Ordinance 1005/92 of 23 October reflects in the implementation of the best practices referred to in the Recommendation of the European Commission no. 2007/526/CE of 18 July23, which includes guidelines resulting from the latest revision of appendix A of the European Convention for the Protection of Vertebrate Animals used for experimental and/or other scientific purposes (Convention ETS 12324). The use of animals for scientific purposes is further governed by the internal regulation of UMinho’s research centres, which are

licenciados para a realização de criação e/ou experimentação animal. Neste contexto, na investigação com animais, salienta-se o cumprimento dos seguintes princípios de boas práticas:1. Os animais não são sujeitos a condições de

desconforto ou sofrimento desnecessários durante o seu transporte para o laboratório e, sempre que possível, durante o processo de experimentação;

2. Será estimulada a aplicação do princípio dos 3 Rs (Reduction, Replacement, Refinement) de Russel e Burch, substituindo-se os animais vivos por métodos alternativos, sempre que possível;

3. Todas as pessoas envolvidas em experimentação animal devem ter formação adequada, seguindo os critérios estabelecidos pela Direção Geral de Alimentação e Veterinária (DGAV) e a correspondente creditação legal atribuída por este organismo;

4. Quando não se verificarem os requisitos de formação referidos na alínea anterior, as pessoas devem ser acompanhadas durante a experimentação animal por aqueles que são possuidores de tal creditação;

2. The application of the Three Rs principles by Russel and Burch (Reduction, Replacement, Refinement) will be promoted, with the substitution of live animals for alternative methods whenever possible;

3. All those involved in animal experimentation must have proper training, according to the criteria established by the Portuguese National Authority for Animal Health (DGAV), and the respective legal accreditation awarded by this organization;

4. In the event that the training requirements mentioned in the previous items are not met, people should be supervised during animal experimentation by duly accredited professionals;


5. A experimentação animal só poderá ter lugar em espaços licenciados pela DGAV;

6. A execução de projetos de investigação e atividades letivas envolvendo animais terá de estar previamente autorizada pela autoridade nacional competente (DGAV);

7. Os investigadores coordenadores dos projetos referidos na alínea anterior poderão requerer apreciação dos mesmos pela CEUM, que emitirá um parecer para acompanhar o processo a submeter à DGAV, de acordo com os prazos estipulados no guia de procedimentos da Subcomissão de Ética para as Ciências da Vida e da Saúde;

8. O parecer referido na alínea anterior, devidamente codificado pela CEUM, com número de identificação único, pode também ser utilizado na submissão de publicações científicas no âmbito do correspondente projeto, como “parecer formal de concordância, em sede de Comissão de Ética, com os procedimentos de experimentação animal realizada no âmbito da publicação”.

5. Animal experimentation can only take place in spaces licensed by DGAV;

6. The execution of research projects and teaching activities involving animals must be previously authorised by the national competent authority (DGAV);

7. The coordinating researchers of the projects referred to in the previous item may request that the projects be assessed by the University of Minho Ethics Committee, which shall issue an opinion to accompany the file to be submitted to DGAV. This must be done within the deadlines established in the guide of procedures of the Ethics Sub-committee for the Health and Life Sciences;

8. The opinion mentioned in the previous item, duly codified by the University of Minho Ethics Committee with a single identification number, can also be used for the submission of scientific publications within the scope of the project entitled “formal agreement opinion issued by the Ethics Committee with regard to the animal experimentation procedures used for the publication”.

Relativamente à experimentação com animais, o não cumprimento das boas práticas e da correspondente legislação enunciadas no presente capítulo implica a aplicação das consequências previstas no Decreto-Lei n.º 129/92, de 6 de julho, ou demais regulamentação e legislação aplicáveis.
