    O cdigo de conduta tica da Universidade do Minho (UMinho), doravante tambm designada por Universidade, estabelece uma afirmao de valores e um conjunto de normas que orientam a misso da Instituio nas suas atividades de ensino e aprendizagem, de formao, de investigao cientfica e de interao com a sociedade, alicerando-se nos princpios ticos de equidade e justia, do respeito pela dignidade da pessoa humana e da responsabilidade pessoal e profissional, em obedincia lei geral e aos estatutos da Universidade e demais regulamentos e legislao aplicvel.

    A comunidade acadmica no pode deixar de estar envolvida com um compromisso tico, assumindo-o na sua agenda, individualmente e como corpo, para o discutir, densificar e desenvolver, com a riqueza que advm da diversidade saudvel, no caminho do progresso do papel do sistema de ensino superior e no respeito pela autonomia da Universidade. Este caminho tem de se fazer caminhando e um dos passos fundamentais dado com a assuno clara e inequvoca daquele compromisso tico.

    The Code of Ethical Conduct of the University of Minho (UMinho), henceforth also referred to as University or Institution, establishes a set of values and norms that guide the mission of the Institution in its activities of teaching, learning, training, research and interaction with society, based on the ethical principles of equity and justice, respect for the dignity of the human person as well as personal and professional responsibility, thus observing general law, the University statutes, and further applicable regulations and legislation.

    The academic community, both as individuals and collectively, is engaged with an ethical commitment, which must be discussed, enhanced and developed with the richness that comes from healthy diversity, establishing a path towards the progress of the role assigned to the higher education system and towards respect for the autonomy of the University. This path is made of small steps and one of the main steps is the clear and unambiguous affirmation of that ethical commitment.

    Thus, the purpose of this code is to provide the academic community with ethical guidelines compatible with the promotion of professionalism

    O objetivo deste cdigo , assim, o de apetrechar a comunidade acadmica com uma linha de orientao tica compatvel com a promoo do profissionalismo e da excelncia na sua ao, em conformidade com os princpios orientadores legais e estatutrios do respeito pela dignidade humana, da igualdade e da justia, da participao democrtica livre e do pluralismo de opinies e orientaes.

    O cdigo enquadra as atividades prosseguidas na Universidade, conforme explicitadas nos seus estatutos, e diz respeito a toda a comunidade acadmica constituda pelo pessoal docente, pessoal investigador, pessoal no docente e no investigador, e pelos estudantes dos 1, 2 e 3 ciclos de estudos conducentes aos graus de, respetivamente, licenciado, mestre e doutor, bem como pelos estudantes de outros cursos ou aes de formao levadas a cabo na Instituio ou em colaborao com esta.

    O presente documento, elaborado pela Comisso de tica da Universidade do Minho (CEUM), est organizado em quatro Captulos. O primeiro diz respeito conduta tica institucional, no mbito de toda a comunidade acadmica. Nos outros trs

    The code refers to all activities undertaken at the University, as indicated in its statutes, and concerns the entire academic community, which is composed of teaching staff, research staff, non-academic staff and the students in the 1st, 2nd and 3rd study cycles leading to the degrees of bachelor, master or doctor, respectively, as well as the students of other programmes or training courses conducted at the Institution or in collaboration with it.

    The present document, drafted by the University of Minho Ethics Committee (CEUM), is divided into four chapters. The first chapter concerns the institutional ethical conduct and applies to the entire academic community. The remaining three chapters deal with the pedagogical and research dimensions. Chapter II is devoted to academic conduct; Chapter III refers to general conduct in research activities; and Chapter IV regards conduct in research with human beings or animals, specifically.

    A tica constitui um pilar vital da qualidade do ensino e da investigao da Universidade, legitimando a sua autonomia e envolvendo um firme compromisso perante os cidados e a sociedade.

    Assim, a Universidade promove os valores da transparncia e da integridade acadmica em todas as suas atividades e adota uma conduta assente nos princpios ticos da justia e equidade, do respeito pela dignidade da pessoa humana e da responsabilidade profissional e social, que se concretiza por normas, deveres e atitudes, de que se salientam os seguintes:1. O respeito pela igualdade de oportunidades

    de toda a comunidade acadmica, nos ao nvel do acesso e desempenho dosestudantes, bem como no da progressodas carreiras profissionais dos docentes,investigadores, trabalhadores no docentese no investigadores, sem qualquer tipo dediscriminao, de dependncia ou subordinao;

    Thus, the University promotes the values of academic integrity and transparency in all of its activities and adopts a conduct grounded upon the ethical principles of justice and equity, respect for the dignity of the human person as well as social and professional responsibility, which is accomplished through norms, duties and attitudes, with a particular emphasis on:1.     Pela relevncia que adquiriu publicamente, perante a sociedade, a nvel regional, nacional e internacional, como centro de criao, divulgao e transferncia de conhecimento e como referncia tica, cultural e humanista, a Universidade tem promovido um relacionamento muito especial com a comunidade exterior, designadamente:1. Ao nvel da promoo e divulgao da cincia, da

    cultura, da educao e dos valores de cidadania;2. Atravs de uma cooperao interinstitucional

    no plano pedaggico, cientfico e tecnolgico,traduzida em aes de formao, seminrios,conferncias, congressos e outras iniciativas;

    Consequncias em casos de conduta imprpria dos docentes, investigadores e trabalhadores no docentes e no investigadores

    Nos termos da lei geral e do artigo 9. dos seus estatutos, a Universidade possuiautonomia disciplinar pertencendo ao reitoro poder disciplinar, assessorado por umconselho disciplinar.

    No caso dos docentes, investigadores e trabalhadores no docentes e no investigadores, o exerccio do poder disciplinar rege-se peloestatuto disciplinar dos trabalhadores que exercemfunes pblicas (Lei n. 58/2008, de 9 desetembro) e demais legislao aplicvel.

    Consequences in case of misconduct by teaching staff, research staff and non-academic staff

    Under the terms of general law and article 9 of its statutes, the University enjoys disciplinary autonomy, and the Rector holds disciplinary power, assisted by a disciplinary council.

    In the case of teachers, researchers and non-academic staff, the exercise of disciplinary power is governed by the disciplinary statutes of employees performing public functions (Law 58/2008 of 9 September) and further applicable legislation.

    Em consonncia com os estatutos da Universidade e tendo presentes os princpios ticos institucionais, a ao dos estudantes, enquanto membros nucleares da comunidade acadmica, deve pautar-se por valores e princpios ticos fundamentais para o sucesso do seu desempenho educativo e para a formao de cidados livres, responsveis e competentes.

    As normas de conduta tica acadmica aplicam-se a todos os estudantes da UMinho, independentemente das qualificaes a obter nas mltiplas atividades a prosseguidas, em especial s de ensino e aprendizagem, de formao e investigao, designadamente no mbito dos ciclos de estudos conferentes dos graus de licenciado, mestre e doutor, bem como noutras aes de formao ps-graduada ou formao contnua, levadas a cabo pela Universidade ou em colaborao com esta.

    As normas de conduta aqui tratadas so aliceradas num conjunto coerente de direitos e de obrigaes de todos os estudantes, dando uma ateno especfica e fundamental ao cumprimento honesto e responsvel dos instrumentos e procedimentos usados na avaliao de conhecimentos, podendo assumir-se como

    In compliance with the statutes of the University and bearing in mind the institutional ethical principles, all actions of students as core members of the academic community must be shaped by ethical principles and values that are crucial to the success of their educational performance and to the upbringing of free, responsible and competent citizens.

    The norms of academic ethical conduct apply to each and every student of UMinho, regardless of the qualifications to be obtained in the various activities therein conducted, especially those of teaching, learning, training and research, and in particular within the scope of study cycles leading to bachelor, master and doctor degrees, as well as other graduate or continuous training courses carried out by the University or in collaboration with it.

    The norms of conduct herein mentioned are based on a coherent range of rights and obligations of all the students, placing specific emphasis on the honest and responsible fulfilment of the procedures used in the assessment of knowledge. They can further be regarded as a chart of ethical conduct or academic code of honour , capable of strengthening habits, values and attitudes of moral and professional character.

    Direitos dos estudantes

    A misso educacional da Universidade implica que os estudantes inscritos em qualquer ciclo de estudos ou atividade reconhecida pela Instituio devem auferir de um ambiente de trabalho profissional e acadmico adequado e baseado no respeito e na confiana mtua entre os colegas e docentes. Devem pois beneficiar de um tratamento assente nos princpios de equidade, justia e igualdade de oportunidades, designadamente:1. Usufruir de um ensino de qualidade que tenha

    por base a formao humana ao mais altonvel nas suas dimenses tica, cultural, social,cientfica, artstica, tcnica e profissional;

    2. Ter acesso atempado a todas as informaesrelevantes para o sucesso do seu desempenho,designadamente da parte dos diretoresde curso, bem como dos Servios Acadmicos,Servios de Ao Social e outros rgose servios relevantes;

    3. Ser informados sobre os planos de estudo,objetivos e programas das unidades curricularesque vo frequentar;

    4. Ver assegurado o direito de participao emrgos da Universidade, atravs dos seusrepresentantes eleitos ou nomeados;

    The educational mission of the University implies that students enrolled in any study cycle or activity acknowledged by the Institution must benefit from a professional and academic work environment based on respect and mutual trust between fellow students and the teachers. Students must therefore receive a treatment based on the principles of equity, justice and equality of opportunities, namely:1. To receive quality teaching based on high-level

    human development in its ethical, cultural,social, scientific, artistic, technical andprofessional dimensions;

    2. To have timely access to all the relevantinformation for the success of their performance,namely on the part of degree programmedirectors as well as the Academic Services,Social Services and other relevant bodiesand services;

    3. To be informed of all the study plans, objectivesand syllabuses of the course units theywill attend;

    4. To enjoy the right to participate in Universitybodies through their elected or appointedrepresentatives;

    9. Poder aceder, nos termos regulamentares,a todos os servios de apoio e aos meiosdisponveis bibliogrficos, informticos,laboratoriais ou outros necessrios aodesenvolvimento dos respetivos projetosde ensino;

    10. Ser tratados com respeito e correo e semqualquer forma de discriminao por todos osmembros da comunidade acadmica;

    11. Ter a garantia da confidencialidade de elementose informaes do foro pessoal ou familiar;

    Acts of dishonesty, incompatible with the academic integrity, are those in violation of the students general duties, and in particular those that benefit students under assessment with results obtained through fraudulent actions that violate procedures adopted for knowledge assessment processes, as well as actions concerning plagiarism, as indicated below.

    Breach of procedures that protect the integrity of the knowledge assessment process

    Among the breach of procedures that protect the integrity of the knowledge assessment process, those of particular note are:1. The use of cheat sheets, notes, texts or other

    unauthorised items during the exams;2. The act of copying the work of someone else,

    situation where one uses ideas, claims, data, images or illustrations from other author(s) without the explicit acknowledgment of the same author(s).

    Below can be found a non-exhaustive list of all the situations considered plagiarism of a literary, artistic or scientific work in the form of a report, article, essay, thesis or dissertation in paper or digital format, in part or in full:

    Consequncias em situaes de conduta imprpria

    Sem prejuzo de no se limitarem as violaes ou infraes aos casos explicitados, fica ainda a advertncia de que, em geral, qualquer ato desonesto e fraudulento que seja praticado para benefcio direto ou indireto do infrator ou infratores, dever ser considerado violao da integridade acadmica e sujeito a procedimentos sancionatrios.

    As sanes disciplinares por atos de conduta acadmica ilcita, bem como a definio e regulamentao dos procedimentos a adotar, sero tratados em conformidade com a lei geral, com o regulamento disciplinar do estudante e demais regulamentos pertinentes.

    Consequences in case of misconduct

    Without prejudice to not restricting the violations or offences against the abovementioned cases, the warning remains that, in general, any dishonest and fraudulent act practiced for the direct or indirect benefit of the offender(s) should be considered as a violation of academic integrity and subject to sanctioning procedures.

    The disciplinary sanctions for acts of illicit academic conduct, as well as the definition and regulation of the procedures to adopt shall be handled in compliance with general law, the students disciplinary regulations and further relevant regulation.

    O cdigo aplica-se a todas as pessoas envolvidas em atividades de investigao cientfica na Universidade ou em colaborao com esta, nomeadamente ao pessoal docente e investigador, aos investigadores no docentes e aos estudantes e bolseiros de investigao.

    O cdigo pretende sublinhar os princpios de boas prticas no campo da investigao cientfica, bem como alertar para casos tipificados de conduta imprpria que urge prevenir e erradicar.

    Como princpios fundamentais deve entender-se que a tica na investigao cientfica implica sempre o respeito pela dignidade da pessoa humana, peloprogresso e valorizao do conhecimento, pelaqualidade e originalidade da investigao, pelaverdade cientfica e pela liberdade de investigao.

    The code applies to all the people involved in activities of research at the University or in collaboration with it, namely to the teaching and research staff, to non-academic staff as well as students and research grant holders.

    The code aims to highlight the principles of best practices in the field of research, and to draw attention to typified cases of misconduct, which must be prevented and abolished.

    As a fundamental principle, it should be understood that ethics in research always implies the respect for the dignity of the human person, for the progress and valorisation of knowledge, for the quality and originality of research, for the scientific truth and freedom of research.

    All those engaged in research have special responsibilities to society, the University, funding entities and the research team involved.

    The values of intellectual honesty, authenticity, objectivity, respect for intellectual property, methodological and experimental rigour, unbiased analysis of data, as well as the non-violation of the rights and dignity of human or animal subjects are all crucial to preserve the credibility and quality of research.

    The most experienced researchers have a key role not only in the scientific supervision and guidance of their younger counterparts but also in the creation and maintenance of an ambience exuding integrity, rigour and critical thinking.

    Cases of misconduct

    Situations that violate the integrity of the researcher and are therefore liable to penalties are typified non-exhaustively below:1. The practice of plagiarism;2. The appropriation of someone elses intellectual

    creations, protected by the rules of intellectualproperty, without legal consent;

    Como princpios gerais, a investigao com seres humanos ou animais deve ser realizada em coerncia com o Cdigo de Conduta tica na Investigao Cientfica, constante do Captulo III.

    Do mesmo modo, a investigao tem de ser cientificamente justificada, cumprir critrios de qualidade cientfica e ser realizada em conformidade com as pertinentes obrigaes e normas profissionais sob a superviso de investigador(es) e/ou clnico(s) devidamente qualificado(s).

    Importa ainda sublinhar que a informao necessria para a avaliao tica do projeto de investigao deve ser facultada por escrito ao(s) rgo(s) de tica competente(s), conforme estabelecido pela legislao aplicvel ou rgo competente. Para o efeito, a Comisso de tica da Universidade do Minho, atravs da Subcomisso de tica para as Cincias da Vida e da Sade, editar um guia indicativo dos procedimentos e do conjunto de documentos a apresentar CEUM.

    As a general rule, research with human beings or animals should be performed in compliance with the Ethical Conduct in Research included in chapter III.

    Similarly, research must be scientifically justified, meet the necessary criteria of scientific quality and be conducted in compliance with the relevant obligations and professional norms under the supervision of duly qualified researchers and/or medical practitioners.

    It should further be noted that the necessary information for the ethical assessment of a research project must be provided in writing to the competent ethical body(ies) as stipulated by the applicable legislation or competent body. For that purpose, the University of Minho Ethics Committee, through the Subcommittee of Ethics for the Life and Health Sciences, shall release a guide with the procedures and all the documents to submit to the University of Minho Ethics Committee.

    In cases where research is conducted with human beings, rules of ethical conduct and best practices must be safeguarded in order to comply with the principles of the Declaration of Helsinki1 and the Oviedo Convention2, the guidelines for human experimentation set out in The Nuremberg Code3, the Convention on Human Rights and Biomedicine4, the guidelines of the Council for International Organizations of Medical Sciences (CIOMS) in collaboration with the World Health Organization (WHO)5,6, the Guide to Good Clinical Practice7 and the basic ethical principles identified in The Belmont Report8 for the protection of human subjects in biomedical and behavioural research.     A investigao em sujeitos humanos dever ainda procurar seguir e preencher os requisitos fixados pela Administrao Regional de Sade do Norte (ARS)11, pela European Commission12 e pela United Nations Educational, Scientific and Cultural Organization (UNESCO)13.

    So igualmente relevantes, em estudos conduzidos internacionalmente e/ou em pases em vias de desenvolvimento, as recomendaes do Nutfield Council on Bioethics14 e da WHO em assuntos ticos em investigao na sade em contexto internacional15.

    As boas prticas acima referidas exigem responsabilidades, salvaguardas, cuidados e metodologias especiais de que se salientam os seguintes princpios: 1. O interesse e o bem-estar do ser humano devem

    prevalecer sobre o interesse da cincia;2. A investigao com seres humanos s dever

    ser iniciada se no houver alternativa deefetividade comparvel;

    workers against the risks arising from the exposure to biological agents while at work.

    Research conducted in human subjects should further attempt to abide by and fulfil the requirements established by the Regional Health Administration of the North (ARS)11, the European Commission12 and the United Nations Educational, Scientific and Cultural Organization (UNESCO)13.

    The recommendations of the Nuffield Council on Bioethics14 and of the WHO on ethical matters pertaining to health-related research in international settings15 are equally relevant in studies conducted at international level and/or in developing countries.

    The best practices identified above require responsibilities, safeguards, care and special methodologies, including the following principles: 1. The interest and well-being of the human subject

    must prevail over the interest of science;2. Research on human beings shall only be

    9. Deve ser garantida a existncia de seguros deproteo adequada contra riscos de acidentes oudanos fsicos ou psicolgicos que possam advirpara os sujeitos humanos, como consequnciada investigao levada a cabo.

    7. Further safeguards should be taken into accountwhen the research concerns vulnerable groupssuch as children, pregnant women, the elderly orpersons with disabilities or infectious, contagiousor oncological diseases. The information providedupon collection of the informed consent must bevery clear regarding not only the confidentialityof the data and anonymity of the participants,but also possible suffering and stress-relatedconsequences for humans;

    8. If the research results in relevant informationfor the present or future health or quality of lifeof the participants, that information shouldbe conveyed to them at a health care orcounselling facility;

    9. A guarantee of insurance should be providedagainst the risk of accidents, physical orpsychological damage that the humansubjects may experience as a result of theresearch conducted.

    Situaes de conduta imprpria em investigao com seres humanos

    No caso da investigao em humanos, quando for detetada uma inconformidade, esta deve ser avaliada e devem ser tomadas aes apropriadas para prevenir a sua ocorrncia, a fim de assegurar que os participantes na investigao estejam protegidos. As inconformidades contnuas ou graves devem ser relatadas s autoridades reguladoras nacionais, ou autoridades competentes equivalentes, tal como definido na Diretiva 2001/20/EC, de 4 de abril, relativa implementao de boas prticas clnicas em estudos clnicos pelos estados membros.

    A suspenso de um estudo clnico pode ocorrer, designadamente, nas seguintes circunstncias: (i) morte de um participante, (ii) alterao no aceitvel na durao, (iii) gravidade ou frequncia de eventos adversos, nomeadamente se os resultados do estudo levarem a comisso de tica (ou autoridade competente) a questionar e reavaliar a relao risco-benefcio, ou a no conformidade do investigador16. Tais suspenses devem considerar uma reviso de todas as informaes cientficas, bem como a segurana e bem-estar dos participantes includos no estudo.

    Cases of misconduct in research with human beings

    In case of research on humans, whenever an anomaly is detected it should be assessed so that precautions may be taken to prevent its occurrence, thus ensuring the protection of the research participants. Continuous or serious anomalies should be reported to the national regulatory authorities or equivalent competent authorities, as defined in Directive 2001/20/EC, of 4 April concerning the implementation of good clinical practices in clinical trials by the member states.

    The suspension of a clinical trial may occur, inter alia, under the following circumstances: (i) death of a participant; (ii) unacceptable changein the trial period; (iii) serious or frequent adverseevents, particularly if the results of the study causethe ethics committee (or competent authority) toquestion and reassess the risk-benefit balanceor the nonconformity of the researcher16. Suchsuspensions presuppose a revision of all thescientific information, as well as the safety and well-being of all the participants involved in the study.

    Nos casos em que na investigao se utilizem animais para fins experimentais e outros fins cientficos, ser cumprida a legislao nacional em vigor: Decreto-Lei n. 129/92, de 6 de julho17; Portaria n. 1005/92, de 23 de outubro18; Portaria n. 466/95, de 17 de maio19; Decreto-Lei n.197/96, de 16 de outubro20; e Portaria n. 1131/97,de 7 de novembro21. Dever ainda ter-se em contaa nova Diretiva Europeia 2010/63/EU, de 22 desetembro de 201022, relativa proteo dos animaisutilizados para fins cientficos, que se prev vira estar transposta para a legislao nacional em2013.     Rules of ethical conduct and best practices in research with animals

    Whenever animals are used in research for experimental and other scientific purposes, the national legislation in force shall be observed: Decree-law 129/92 of 6 July17, Ordinance 1005/92 of 23 October18; Ordinance 466/95 of 17 May19; Decree-law 197/96 of 16 October20 and Ordinance 1131/97 of 7 November21. One should further observe the new European Directive 2010/63/EU of 22 September 201022 concerning the protection of animals used for scientific purposes, which is expected to be transposed to national legislation in 2013. The enforcement of the provisions laid down in Annex I of Ordinance 1005/92 of 23 October reflects in the implementation of the best practices referred to in the Recommendation of the European Commission no. 2007/526/CE of 18 July23, which includes guidelines resulting from the latest revision of appendix A of the European Convention for the Protection of Vertebrate Animals used for experimental and/or other scientific purposes (Convention ETS 12324).     2. Ser estimulada a aplicao do princpio dos3 Rs (Reduction, Replacement, Refinement) deRussel e Burch, substituindo-se os animais vivospor mtodos alternativos, sempre que possvel;

    3. Todas as pessoas envolvidas em experimentaoanimal devem ter formao adequada, seguindoos critrios estabelecidos pela Direo Geralde Alimentao e Veterinria (DGAV)e a correspondente creditao legal atribudapor este organismo;

    4. Quando no se verificarem os requisitos deformao referidos na alnea anterior, aspessoas devem ser acompanhadas durantea experimentao animal por aqueles que sopossuidores de tal creditao;

    3. All those involved in animal experimentationmust have proper training, according to thecriteria established by the Portuguese NationalAuthority for Animal Health (DGAV), and therespective legal accreditation awarded by thisorganization;

    4. In the event that the training requirementsmentioned in the previous items are not met,people should be supervised during animalexperimentation by duly accredited professionals;

    5. Animal experimentation can only take place inspaces licensed by DGAV;

    6. The execution of research projects and teachingactivities involving animals must be previouslyauthorised by the national competentauthority (DGAV);

    7. The coordinating researchers of the projectsreferred to in the previous item may request thatthe projects be assessed by the University ofMinho Ethics Committee, which shall issue anopinion to accompany the file to be submitted toDGAV. This must be done within the deadlinesestablished in the guide of procedures of theEthics Sub-committee for the Health andLife Sciences;

    8. The opinion mentioned in the previous item,duly codified by the University of Minho EthicsCommittee with a single identification number,can also be used for the submission of scientificpublications within the scope of the projectentitled formal agreement opinion issued bythe Ethics Committee with regard to theanimal experimentation procedures used forthe publication.
